Terms of Service

1. Agreement to Terms

By accessing or using Reasons Why ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

Reasons Why is operated by an individual developer based in the European Union ("we," "our," or "us").

2. Service Description

Reasons Why is a couples appreciation app that enables partners to:

  • Send daily appreciation messages to each other
  • View received messages on an iOS home screen widget
  • Build a shared archive of appreciation messages over time
  • Connect with a partner via secure invite codes

3. Eligibility

To use the Service, you must:

  • Be at least 16 years of age (in accordance with GDPR requirements)
  • Provide accurate and complete registration information
  • Maintain only one account per person
  • Keep your account credentials secure and confidential

If you are between 16 and 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Account Registration

To use the Service, you must create an account by providing your name, email address, and a secure password. You are responsible for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Partner Linking

The Service allows you to connect with one partner at a time:

  • You may invite a partner using a 6-character invite code sent via email
  • Invite codes expire after 7 days
  • By accepting an invitation, both parties consent to share messages with each other
  • Each account can only be linked to one partner at a time
  • You may unlink from a partner by deleting your account

6. User Content

You retain ownership of the messages ("Reasons") you create and send through the Service. By using the Service, you grant us a limited license to transmit, store, and display your messages to your connected partner.

You agree that your messages will:

  • Not exceed 500 characters in length
  • Not contain harassment, threats, or abusive content
  • Not contain illegal content or promote illegal activities
  • Not contain spam, malware, or malicious links

We do not actively monitor the content of messages between partners, as this is private communication. However, we reserve the right to remove content or terminate accounts that violate these Terms.

7. Acceptable Use

You agree not to:

  • Use the Service to harass, abuse, or harm your partner or any other person
  • Create multiple accounts or use the Service for any automated or bot-related purposes
  • Attempt to circumvent security measures or access unauthorized areas of the Service
  • Impersonate another person or misrepresent your identity
  • Use the Service for any illegal purpose or in violation of any applicable laws
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Interfere with or disrupt the Service or servers connected to the Service

8. Intellectual Property

The Service, including its design, features, and content (excluding user-generated content), is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not use our name, logo, or branding without our prior written consent.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Push Notifications and Communications

The Service may send you push notifications when your partner sends you a message, as well as optional daily reminders. You can manage notification preferences in your device settings. By using the Service, you consent to receive transactional emails related to your account (such as partner invitations and security notices).

11. Termination

By You: You may delete your account at any time through the app settings. Upon deletion, all your data will be permanently removed, including your profile, messages, and device tokens. Your partner will be unlinked but their account and messages will remain intact.

By Us: We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include violation of these Terms, abusive behavior, or extended periods of inactivity.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for any loss of data or messages.

Relationship Disclaimer: Reasons Why is a communication tool and does not provide relationship advice, counseling, or therapy. We are not responsible for the content of messages between partners or the outcomes of your relationship.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any content or conduct of any third party on the Service

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us (if any) in the twelve months prior to the claim.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the European Union and the member state where the operator resides, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to the competent courts of the operator's place of residence.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Effective" date at the top. Your continued use of the Service after any changes indicates your acceptance of the updated Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
